Terms and Conditions
The Magic Castle online gift shop is a department of the Academy of Magical Arts, Inc. (AMA). The AMA is a not-for-profit company. The following terms and conditions listed below will apply between you and the AMA for the sale and purchase of the items contained in your cart. The terms do not affect your statutory rights.

Your Undertakings and Warranties
You warrant that the information given on your order form is complete and accurate.

Payment
All credit and charge card holders are processed through WooCommerce and Authorize.net and are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to us, your order will not be accepted and the AMA will not be liable for any delay or non-delivery.

 


Merchandise Orders Terms and Conditions

Availability of goods and prices
Goods will be sent to the address given by you in your order and stated in the Checkout page. Please note that occasionally goods ordered may be sent to you in installments. We will make every effort to advise you (by email or phone) if this is the case. We make every attempt to ensure that all prices on our website are accurate, however discrepancies may occur. If we discover an error in the price of goods already ordered we will inform you as soon as possible and ask that you reconfirm your order at the correct price, whilst also giving you the option to cancel it. If we are unsuccessful in contacting you we will consider the order cancelled. If we cancel your order, you will receive a full refund.

Acknowledgement of Order
When you have completed your order, you will be sent an e-mail confirmation. It will state what the products are on order, the total cost including sales tax (where appropriate) and shipping charges, together with delivery and invoice details. If for any reason your order cannot be processed, a member of the customer service team will contact you (by email or phone) to explain the nature of the difficulty. We will send a confirmation email when the goods have left our location. This confirmation e-mail amounts to an acceptance by the AMA of your offer to buy goods.

Returns and Exchanges
You have 30 days after the purchase date to decide if an item is right for you. The AMA will refund or exchange an item, provided that it has not been used, damaged, soiled, washed, altered or worn and that all labels and tags (if applicable) are attached.

Return In-Store
Bring the item(s) you wish to return to the Magic Castle. Make sure you also bring the delivery email and the credit or debit card you used for your purchase. Please note that our stores cannot accept returns due to issues with the items you ordered, such as wrong, missing or defective items. For orders with these issues, please email giftshop@magiccastle.com.

Return by Mail
Contact the store manager by email at giftshop@magiccastle.com and explain your situation. Please wait for your return approval prior to shipping any items back to the AMA. The return address is:

Your refund will be issued to the same credit card you used for the original purchase. Shipping and handling costs are your responsibility and are not refundable. If you mail in your return, please allow up to 2 weeks for the credit to be reflected in your account. Allow up to 2 billing cycles for the credit to appear on your credit card statement.

Exchanging items by mail
If you wish to exchange an item by mail, follow the return procedure above and include the item you would like to receive in place of the original item sent. In the case of an even exchange, this will not be processed as a new order and your credit card will not be charged a second time.

Order Cancellation
You may cancel your order any time before the order is shipped. Once the order is shipped, you will receive, via email, a shipping confirmation that contains tracking information. Once a product is shipped, the Return and Exchange Policy will apply.

The AMA may cancel orders for any reason. Some common situations in which orders are cancelled may include: The item is out of stock and there are no plans of restocking it, the buyer is not eligible for the item purchased (member merchandise or events) pricing errors, or credit card payment is declined by the issuing financial institution.

For members-only items: While this item may be available to you, each order is checked against our current member database to confirm the buyer is an active member in good standing and eligible for the members only item being purchased. If the name on the order does not match what we have on file, the order will be cancelled and refunded completely. Members only items purchased as a gift for a member will be refunded and the order will not be honored.

Damaged goods or incorrect deliveries
Returns and exchanges are subject to the following conditions: (i) the goods must be stored in appropriate conditions; if you do not store them in appropriate conditions we cannot be held responsible for faults or problems that arise as a result; (ii) any claim by you in respect of any shortages and/or defects in the goods must be notified to us by you within seven days of the delivery date, stating the nature of the shortage/defect and quoting the invoice number. Failure to so notify us will deem you to have accepted the goods. In some cases, the AMA may require you to return the defective goods to the AMA at its cost. Where you make a valid claim in respect of any shortages or defects and we are liable for the claim, we can, at our option, make up the shortages or replace the goods free of charge, or refund the price of the goods in question to you. In addition, for defective goods, we will refund you reasonable costs incurred for postage of the goods, but we shall have no further liability to you. If you do not notify the AMA accordingly, the AMA shall have no liability for any defects and you shall be bound to pay for the goods.

International Shipping
If your delivery address is not within the United States, you may be subject to import duties and taxes, which are levied once a shipment reaches your country. Any such additional charges for customs clearance must be borne by you. You should note that customs policies vary widely from country to country; The AMA advises each customer to contact their local customs office for further information. Be aware that cross-border shipments are subject to opening and inspection by customs authorities.

Force Majeure
The AMA shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

 


Magic Castle and AMA Gift Card Terms and Conditions

Once an order is placed, you or your recipient will be mailed a physical gift card to be used anywhere inside the Magic Castle® (includes Valet).
Gift cards are not an invitation to the Magic Castle®. Recipients of gift cards must receive an invitation from an active member prior to attending. Be aware of processing and shipping times prior to your purchase. If you require a gift card sooner, please make a note in the comments during checkout. Deliveries are made Monday through Friday via USPS. Allow up to 3 business days for processing your payment and shipment. Allow up to 2 weeks for USPS to deliver the gift card(s). We also offer pick-up options.
All gift cards are eligible for free shipping. If you would like to have a gift card shipped to a location other than your billing address, please include the recipient’s name and mailing address in the ‘Other Notes’ section during the checkout process. If no address is provided in the ‘Other Notes’ section, the gift card will be mailed to the billing address on the order. The AMA is not liable for additional shipping charges when pertaining to the gift card being sent to an address other than what the buyer provides.
Change will not be given for unused funds on gift cards. Gift cards are not refundable or eligible for exchange.
Take note of the number on your gift card once it is received. If your gift card is lost or stolen, this is the only way the AMA can replace it. Gift cards being replaced will be deactivated and will be unusable for future transactions.
We currently do not accept gift cards as payment in our online gift shop, for online event ticket purchases, magic course enrollment, or membership dues payments.

 


Event Terms and Conditions

Unless otherwise stated, all events held at the Magic Castle are considered ‘Members Only’ events. Active members in good standing may purchase tickets for any event made available via this website. Tickets to events must be purchased by a member. Members may purchase a limited number of additional tickets for their guests, if the event allows. Each order is checked against our current member database to confirm the buyer is an active member in good standing and eligible for the event ticket being purchased. Tickets purchased by non-members, even in the case of a gift, will be refunded and the order will not be honored. Purchasing member must be in attendance for the event the tickets were purchased for and non-members will not be admitted otherwise. Changes to ticket orders may be made up to 72 hours prior to the event start time by emailing broman@magiccastle.com with the order number and any changes that need to be made, pending availability. Cancellations within 72 hours of the event start time or failure to show to the event are considered ticket forfeiture and will not be eligible for refunds of any kind.

 


Magic University Terms and Conditions

All magic courses must be paid for in full prior to attending. Instructors are not able to accept payment for classes. Each class holds up to 15 students, except for the Performance Workshop, which holds 10 students maximum. There must be at least 10 students for the AMA to carry out any class, regardless of subject matter. Specific classes may be postponed due to holidays, large events, and/or unforeseen circumstances. The AMA reserves the right to reschedule or cancel classes if deemed necessary. It is the student’s responsibility to be in the classroom at the start of each class. Missed time and classes cannot be made up. Students are required to abide by all clubhouse restrictions and requirements. Students may not attend magician member lectures or issue guest cards. Other restrictions may apply. The AMA reserves the right to alter class schedules, lesson plans, instructors, privileges, and/or revoke any access benefits at any time. Members who are suspended from the AMA are not eligible to attend Magic University. The Academy of Magical Arts reserves the right to update or alter this information at any time for any reason. All purchases for the Magic University program are subject to these terms. The AMA may also cancel or change any purchase(s) at any time with notice given to the purchaser.

Magic University changes, cancellations, and refunds: Refunds must be requested no later than two weeks prior to the course start date. Otherwise, no refunds will be issued under any circumstance. Please email magicuniversity@magiccastle.com with any changes you would like to make to your order. Be sure to include your order number for our reference.
Changes: There is no charge for course date transfers (once per order) as long as you email us at least 14 days prior to the start date of the course you have enrolled in.
Cancellations: The buyer will be issued a full refund if notice is given at least 14 days prior to the start date of the class purchased. Changes and cancellations cannot be made within 14 days of the start date and refunds will not be issued.

Promotion Code Terms & Conditions

Promotional codes entitle you, at the time of ordering, to a saving on a new order placed with the AMA. Details of any minimum or percentage discount, including sales tax and saving entitlement can be found in your voucher email/flyer/promotional material. Promotion codes are only valid for orders placed online. The AMA reserves the right to decline to accept orders where, in its opinion, a promotion code is invalid for the order being placed. Promotion codes are only valid for a limited period of time. The expiration date should be publicized with the relevant promotion code. Only one promotion code can be used per order. Promotion codes are not valid in conjunction with any other promotion. Promotions not valid on sale items or other discounted items. In the event of product returns, refunds will be given for cost of the original purchase once the discount is applied, less any shipping costs charged on the original order. In the event of part of the order being returned, the value of the discount applied on that order will be spread between the goods proportionately. The sum exceeding this value, less any shipping costs charged on the original order, will be returned to the customer. In the event of any returns meaning that the order no longer qualifies for the promotion advertised, the AMA reserves the right to deduct the value of the offer from the refund. Where a ‘purchase (quantity) and receive a free (item)’ offer is advertised, the item with the lowest price is free. The AMA reserves the right to terminate the validity of any promotional code at any time.

 


Data Protection

The AMA will never make your personal details available to other companies for marketing purposes. We will keep a record of your address details with the intention of sending your order. Information you enter into our registration forms may be collected and stored briefly by us so that we may contact you in relation to the nature of your attempted transaction, even if you do not confirm the transaction. This may be used to send operational emails to enquire as to why the purchase was not completed. We will not use this data for any other purpose, we will not store it for longer than necessary and we certainly will not share it with any other company. Limitation of Liability
Although we take every care to ensure accuracy, we make no warranties as to the accuracy of the information we place on our web pages. The extent of our liability for any breach of these terms and conditions shall be limited to the value of the goods ordered by you in the relevant transaction.

Validity
By placing an order of any kind, you accept these terms and conditions. The terms and conditions are subject to change at any time, and it is your responsibility to check these terms and conditions regularly before ordering products in case there are any changes. If for any reason part of these terms and conditions is unenforceable; the validity of the remaining terms and conditions shall not be affected. These Terms shall be governed by and construed in accordance with United States Law and agree to submit to the exclusive jurisdiction of the US courts.
